About the Construction Contracts Act 2013

The Construction Contracts Act 2013 (the CCA or the Act) was introduced on 25 July 2016 to assist the flow of money between parties who have contracted to perform construction operations under a construction contract in Ireland.

Either party to the construction contract has the right to refer any dispute relating to payment under the contract to be decided by an independent person (the adjudicator) agreed to by the parties or failing agreement, appointed by the Minister of Public Expenditure and Reform.

The Act provides for the adjudicator to make a decision within 28 days of a referral being made, which can be extended up to a further 14 days with the consent of the party referring the dispute.

The Act is unique, but has similarities with other security of payment legislation enacted elsewhere in the world.
